Terms of Service

By accessing or using the FunChat mobile application, website, or related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not accept these Terms, you may not use the Service. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.  

1.1 Age Requirement: You must be at least 18 years old to use the Service. Accounts suspected of belonging to minors will be terminated, and associated data deleted.

1.2 Accuracy of Information: You agree to provide truthful and complete registration details. Misrepresentation of age, identity, or other information may result in immediate account termination.  

1.3 Prohibited Users: Individuals required to register as sex offenders or located in jurisdictions where the Service is restricted are prohibited from using the Service.  

2.1 Security: You are responsible for maintaining the confidentiality of your username and password. Notify us immediately at supports@gofunchat.com of unauthorized account access.

2.2 Content Liability: You are solely responsible for all content (e.g., messages, photos, videos) posted or shared through your account.  

2.3 Termination: We reserve the right to suspend, restrict, or terminate your account for violations of these Terms, with or without notice.  

3.1 Content Guidelines:  
You agree not to post, transmit, or share content that:  
- Promotes hate, discrimination, violence, or harm against individuals or groups.  
- Contains nudity, sexually explicit material, or graphic violence.  
- Infringes intellectual property rights (e.g., copyrighted material, trademarks).  
- Involves spam, phishing, pyramid schemes, or unauthorized commercial activities.  
- Discloses private information (e.g., addresses, phone numbers) without consent.  
- Impersonates others or misrepresents affiliations.  

3.2 Prohibited Activities:  
You agree not to:  
- Use automated tools (e.g., bots, scrapers) to extract data or disrupt Service operations.  
- Upload malware, viruses, or engage in hacking attempts.  
- Solicit financial information, passwords, or personal details from other users.  
- Create multiple accounts for abusive purposes (e.g., spamming, evading bans).  
- Circumvent geographic restrictions or manipulate location data.  

4.1 User Content:  
- You retain ownership of content you post but grant FunChat a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute it within the Service.  
- You warrant that your content does not violate third-party rights or laws.  

4.2 Moderation:  
- We may review, edit, or remove content at our sole discretion, particularly if it violates these Terms or harms the Service’s reputation.  

5.1 Subscriptions:  
- Auto-Renewal: Subscriptions renew automatically unless canceled via your Apple or Google account settings at least 24 hours before the renewal date.  
- Refunds: No refunds are provided for unused subscription periods. Introductory pricing applies only to first-time subscribers.  
- Changes: FunChat may modify subscription fees, features, or terms at any time.  

5.2 Virtual Currency (diamonds):  
- Non-Transferable: Diamonds purchased or earned are non-refundable, non-transferable, and expire upon account deletion.  
- Revocation: FunChat reserves the right to modify, revoke, or expire Virtual Currency without notice or compensation.  

 
6.1 By You: You may delete your account at any time via in-app settings.  
6.2 By FunChat: We may terminate accounts for violations of these Terms, fraudulent activity, or prolonged inactivity.  
6.3 Effect of Termination:  
- Virtual Currency and unused subscriptions are forfeited without refund.  
- Content may be retained for legal compliance or safety purposes.  

7.1 Service “As-Is”:  
- The Service is provided without warranties of accuracy, reliability, or uninterrupted access.  
- We disclaim liability for user conduct, third-party content, technical malfunctions, or damages arising from Service use.  

7.2 Third-Party Risks:  
- Interactions with other users or advertisers are at your own risk. We do not screen users or endorse third-party products/services.  

You agree to indemnify FunChat, its affiliates, and employees against claims, losses, or expenses (including legal fees) arising from:  
- Your breach of these Terms.  
- Misuse of the Service or infringement of third-party rights.  

9.1 Binding Arbitration:  
- Disputes related to the Service will be resolved through binding arbitration administered by a recognized authority, excluding small claims.  
- Class actions and jury trials are waived.  

9.2 Governing Law:  
- These Terms are governed by U.S. law. Software export complies with U.S. regulations.  

10. Intellectual Property  
10.1 Copyright Policy:  
- Report copyright infringement to supports@gofunchat.com.
Include:  
- Proof of ownership.  
- Description of infringing material.  
- Your contact details.  
- Repeat infringers will have accounts terminated.  

11. Safety and Moderation

11.2 Background Checks:  

- We reserve the right to conduct criminal background checks using publicly available records.  

12. Third-Party Links and Advertisements

- The Service may contain links to third-party sites or ads. We are not responsible for their content, accuracy, or practices.  

12. Limitation of Liability  
- FunChat’s liability for any claim is limited to the amount paid by you for the Service, if applicable.  
- We are not liable for indirect, incidental, punitive, or consequential damages.
